WHAT HAPPENS IF DEPUTY PRESIDENT RESIGNS ? HOW CAN HE BE IMPEACHED ?

There is no doubt William Ruto is troubled man in Jubilee party. Every just seems to work against him and things have not gone as expected throughout this second term in office. His close allies have been fired from influential Government posts with Ruto watching helplessly.

The relationship between President Uhuru Kenyatta and William Ruto seems to be deteriorating everyday with Ruto accused of derailing Jubilee development agenda to focus on his 2022 politics.

One of the option William Ruto is to resign and begin to focus on his vision to become president come 2022. There are scenarios and what is likely to happen.

HOW CAN DEPUTY PRESIDENT RESIGN ?

According to the constitution of Kenya chapter 148, The Deputy President may resign from office at any time by notice, in writing, addressed to the President and the resignation shall take effect on the date and at the time specified in the notice, if any, or if a date is not specified, at noon on the day after the notice is delivered.

HOW DEPUTY PRESIDENT CAN BE IMPEACHED

The process of impeaching a deputy president is not an easy one. The Constitution of Kenya gives the Senate and the National Assembly the power to remove the deputy president from the office.

According to the Constitution, the Deputy president can be impeached if a motion by a member of the national assembly is supported by a third of all the members on the grounds of gross misconduct, Incapacity to serve, Serious crime under national and international law.

Then the speaker of the national assembly shall convene a meeting within seven days and inform speaker of the senate.

The speaker form a special committee consisting of 11 members to investigate the allegations and report allegations to the house.

The deputy president can then appear in the senate and defend himself.

For the impeachment to be successful, at least two-thirds of all the members of the Senate will have to vote to uphold the impeachment motion.

WHAT HAPPENS WHEN DEPUTY PRESIDENT SEAT IS VACANT ?

Within fourteen days after a vacancy in the office of Deputy President arises, the President shall nominate a person to fill the vacancy, and the National Assembly shall vote on the nomination within sixty days after receiving it.
